Definitions
For purposes of these Terms of Service (the "Terms"): "Site" means the website located at voogli.com; "Hillcrest Bathware," "we" and "us" mean the business that operates the Site; "Customer" or "you" means any person who accesses the Site or buys from it; and "Order" means any request to purchase products submitted through the Site.
1. Acceptance
1.1 By accessing the Site or submitting an Order, the Customer accepts these Terms together with our Privacy Policy, Shipping Policy and Refund & Returns Policy. A Customer who does not accept them should refrain from using the Site.
2. Identity of the Seller
2.1 Hillcrest Bathware is the trade name of Capstone Ush INC, whose base is in Hattiesburg, Mississippi. Through its online store it offers soap dispensers, toothbrush holders and bathroom counter accessories.
3. Eligibility and Accuracy of Information
3.1 Use of the Site constitutes the Customer's confirmation that he or she is 18 years of age or older, or is acting with the consent of a parent or legal guardian.
3.2 The Customer shall supply information that is accurate, current and complete whenever an Order is placed.
4. Product Listings
4.1 The Site offers soap dispensers, toothbrush holders and bathroom counter accessories. The size, materials and included items of a listing are stated on the product page for that listing. Colors received may vary slightly from the way they appear on screen.
4.2 Hillcrest Bathware reserves the right to change, update or withdraw any product listing at any time, without advance notice.
5. Delivery Territory
5.1 Orders are delivered solely to addresses within the United States, meaning the 50 states and Washington, DC. Shipment to destinations outside that territory is not offered. Complete details appear in our Shipping Policy.
6. Pricing, Taxes and Shipping Charges
6.1 Every price on the Site is expressed in US Dollars (USD) and excludes applicable sales tax, except where otherwise indicated.
6.2 Before confirming an Order, the Customer is shown its complete cost at checkout, covering the product price, any shipping fees and taxes. Hillcrest Bathware may revise its prices at any time.
6.3 Standard shipping is provided free of charge on Orders delivered within the territory described in clause 5, and no minimum Order value applies.
7. Payment
7.1 The payment methods offered for a given Order are displayed at checkout prior to confirmation; further information is set out in our Payment Policy. Payment is handled securely at checkout.
7.2 No hidden fees apply; every charge is presented to the Customer before the purchase is confirmed.
8. Cancellation
8.1 A Customer wishing to cancel an Order should write to support@voogli.com at the earliest opportunity. An Order that has already been processed or dispatched may no longer be capable of cancellation.
9. Returns and Refunds
9.1 Returns are accepted where an item arrives with a manufacturing defect, has been damaged in transit, or is not the item ordered. Eligibility requirements, applicable timeframes and return instructions are governed by our Refund & Returns Policy.
10. Account Credentials
10.1 A Customer who opens an account bears responsibility for keeping the associated login credentials confidential, and must notify us without delay at support@voogli.com upon suspecting any unauthorized access.
11. Prohibited Conduct
11.1 In using the Site, the Customer shall not:
- carry out any unlawful or fraudulent activity;
- disrupt the security or functioning of the Site;
- use scraping or copying to reproduce material from the Site absent our written permission;
- introduce malicious software or other harmful code; or
- seek unauthorized access to any portion of the Site.
12. Intellectual Property
12.1 All material on the Site, including product images, text, logos and graphics, belongs to or is licensed to Hillcrest Bathware and enjoys protection under applicable intellectual property laws. Such material may not be reproduced, distributed or otherwise used without our prior written consent.
13. Disclaimer of Warranties
13.1 The Site and all products are furnished on an "as is" and "as available" basis. Although we endeavor to keep the Site accurate and reliable, Hillcrest Bathware gives no guarantee that the Site will operate without interruption or error, or that it will be free of harmful components.
14. Limitation of Liability
14.1 To the fullest extent permitted by law, neither Hillcrest Bathware nor Capstone Ush INC shall bear liability for any indirect, incidental, special, consequential or punitive damages that result from the Customer's use of the Site or purchase of products, including, without limitation, loss of data, revenue or profits.
15. Privacy
15.1 The Customer's use of the Site is additionally subject to our Privacy Policy, which sets out how personal information is collected, used and protected.
16. Amendment of Terms
16.1 Hillcrest Bathware may amend these Terms periodically, and each amendment will be published on this page together with a new effective date. A Customer who continues to use the Site after an amendment is published is deemed to accept the amended Terms.
17. Governing Law and Jurisdiction
17.1 The laws of the United States and of the State of Mississippi govern these Terms. Any dispute arising out of these Terms or the Customer's use of the Site shall be resolved by the courts situated in Mississippi.
